CELEX – Headnote Field (celexheadnote)


The Headnote field in the CELEX database on Justis is part of the Reports group, and contains a summary of the Court’s decision. For example:

Headnote     1. When defining the relevant market for the purpose of applying Article 86 of the Treaty, the competitive conditions and the structure of supply and demand on the market are relevant criteria for determining whether certain products are interchangeable with others.

2. Application of Article 86 presupposes a link between the dominant position and the alleged abusive conduct, which is normally not present where conduct on a market distinct from the dominated market produces effects on that distinct market. In the case of distinct, but associated, markets, application of Article 86 to conduct found on the associated, non-dominated, market and having effects on that associated market can only be justified by special circumstances.

In certain case law records that were originally only in French, Justis Publishing has added an English headnote. For example:

The Court upheld a complaint by the Commission that Italy was in breach of its obligations under the EC Treaty in failing to enact into domestic law the provisions of Directive 85/411, modifying Directive 79/409, on the protection of wild birds.

It is for the member States to identify the species of wild birds which are in need of the specific measures of protection and conservation required by article 4(1) of the Directive. They are better placed than the Commission to know which among the species listed in Appendix I to the Directive are to be found on their territory.

In documents, this field is sometimes shown as “Headnote”, sometimes shown as “Summary”, and sometimes does not have a heading.

In the Outline, this field is called “Summary”.

If you want to use the Headnote field on the Quick Search screen or in the Full Text box on the Search In EU screen, its name is “celexheadnote”, and you can use a search such as:

celexheadnote[market* and vehic*]

Used only in the Case Law database (Sector 6).

In previous versions of Justis, the index for this field was called summary, not celexheadnote.

In previous versions of Justis, the headnotes added by Justis Publishing were in a separate English Headnote (headnote) field.
